At Pilates Locale, we’re committed to creating a safe, supportive and transparent experience for our community. These Terms & Conditions outline how our studio operates and what you can expect from us. By becoming a member, booking a class or visiting the studio, you agree to these guidelines designed to protect your time, wellbeing and the integrity of our space..

1. Introduction

These Terms and Conditions govern your access to and participation in classes, sessions, memberships, and related services offered by AD Pilates Pty Ltd ACN 686 192 843 t/as Pilates Locale (“Pilates Locale”, “we”, “us” or “our”). By booking a session, purchasing a membership or attending the studio, you agree to be bound by these Terms.

1.1 Definitions

In these Terms:
  • “Client” / “you” / “your” means any person purchasing services from us, including membership holders, casual attendees, and participants.
  • “Services” means Pilates classes, memberships, studio access, events, and any related offerings provided by Pilates Locale.
  • “Momence” means the third-party booking, scheduling and CRM platform used to facilitate membership, payment, and session management.
  • “Terms” means these General Terms and Conditions, as amended from time to time.

2. Memberships and class access

2.1. Membership Types and Inclusions

  • We offer a range of membership options, passes, and single-session purchases, each with specific pricing, inclusions, and expiry dates. Full details are available on our website and the Momence platform.
  • Memberships include a set number of sessions per week or month and may include access to group, private, or virtual Pilates sessions.
  • Some memberships may auto-renew unless cancelled in accordance with clause 6.

2.2. Minimum Terms

  • Memberships have a minimum term of four (4) weeks, after which they continue on a rolling billing cycle (e.g. fortnightly or monthly, depending on the selected membership) unless cancelled in accordance with clause 6.
  • New members are entitled to a statutory 48-hour cooling-off period under the Australian Consumer Law (ACL), during which they may cancel for a full refund. This right only applies to new members entering into a membership for the first time. If you use any services during the cooling-off period, we may deduct reasonable charges before issuing a refund.

3. Pricing & payments

3.1. Payment Processing

  • All fees are processed securely via Momence using the payment method you nominate (credit card or direct debit).
  • We rely on Momence, a trusted third-party payment provider, to ensure the secure processing of payment and storage of payment information. We do not store your full payment details.
  • By signing up, you authorise us to debit your account for all applicable fees.
  • Transaction fees may apply and are disclosed at the point of purchase. We do not accept Amex or Diners Club.

3.2. Failed Payments and Account Arrears

  • If your payment fails, we may suspend your access to classes and apply a $10 dishonour fee.>
  • You will receive a notification via Momence, and access will be reinstated once your account is brought up to date.

3.3. Changes to Pricing

  • We may vary membership pricing and billing terms with 30 days’ written notice. If you do not accept the change, you may cancel your membership under clause 6.

3.4. Merchandise and Gift Vouchers

  • Pilates Locale may offer merchandise and gift vouchers for purchase. Vouchers are valid for the dollar amount indicated and are not redeemable for cash. Lost or stolen vouchers will not be replaced. Refunds are not provided for merchandise unless required by law.

4. Class bookings & attendance

4.1. Booking System

  • All sessions must be booked via Momence. It is your responsibility to book and attend classes within your entitlement period.
  • Sessions do not roll over to future billing periods unless otherwise agreed.
  • Pilates Locale reserves the right to cancel or reschedule sessions without prior notice. No refunds or compensation will be provided for schedule changes, but we will make reasonable efforts to notify affected participants.

4.2. Late Arrival

  • You must arrive on time for your session. Clients arriving more than 5 minutes late will not be permitted to enter and will forfeit the session.

4.3. Studio Conduct and Entry Conditions

  • Participants under the age of 18 years old must have written consent from a parent or guardian to attend sessions at Pilates Locale
  • Pilates Locale reserves the right to refuse entry or remove any person from the studio who is disruptive, abusive, intoxicated, or otherwise behaving inappropriately.
  • All participants must treat instructors, staff, other clients, and studio property with respect. For hygiene, socks must be worn at all times in the Studio room. Socks are at discretion in the Mat room.
  • Mobile phones must be turned off during sessions unless approved for emergency reasons.
  • Pilates Locale is not responsible for the safekeeping of your personal belongings. Please avoid bringing valuables to the studio and use storage areas provided at your own risk.

4.4. Introductory Offers and Trial Packs

  • Introductory offers and trial packs are only available to new clients unless otherwise specified. They are non-transferable, non-refundable, and may be subject to expiry periods or usage limits. Misuse may result in termination of your access to services.

5. Cancellation & no-show policy

5.1. Class Cancellations

  • You must cancel any booked class at least 8 hours prior to the scheduled start.
  • Your session credit will be forfeited, and
  • You may be charged a $15 late cancellation fee or $20 no-show fee.

5.2. Waitlist Policy

  • You may join a waitlist for full classes. If a spot becomes available, you will be automatically added to the class up to 1 hour before the start.
  • You must remove yourself from the waitlist if you no longer wish to attend. If added from the waitlist and you don’t attend, late cancellation or no-show fees will apply.

5.3. Suspension and Termination

  • We reserve the right to suspend or terminate access to our classes or booking system in cases of misuse, breach of our terms, or inappropriate conduct.

6. Membership hold and cancellation

6.1. Membership Hold

  • You may place your membership on hold up to three (3) months per calendar year, with a minimum hold period of two (2) weeks.
  • Holds must be requested with seven (7) business days’ notice via email to hello@pilateslocale.com.

6.2. Cancellation Policy

  • You may cancel your membership at any time after the initial four-week minimum term by giving 30 days’ written notice.
  • Cancellation requests must be emailed to hello@pilateslocale.com.

7. Studio etiquette & conduct

  • Please arrive early and wear suitable activewear.
  • Mobile phones must be switched off or on silent.
  • We reserve the right to refuse service or cancel a membership if a participant engages in disruptive, unsafe or inappropriate behaviour.

8. Risk acknowledgement & waiver

8.1. Medical Warning / Risk Acknowledgement

  • Before participating in any Pilates Locale session, you should consult with a healthcare professional to ensure that the exercises are suitable for your health and physical condition. You must notify us of any pre-existing injuries, conditions, or pregnancy before commencing a session. Participation in our sessions is at your own risk, and you acknowledge that Pilates involves physical exertion and the risk of personal injury. You should stop immediately if you feel pain or discomfort.

8.2. Voluntary Participation and Health Disclosure

  • By participating in classes or sessions, you confirm that:
  • You are medically fit to undertake physical activity;
  • You will disclose any injury, illness, or condition to your instructor before class;
  • You understand the nature and intensity of Pilates exercise and the potential for injury.

8.3. Waiver of Liability

  • To the maximum extent permitted by law, you release Pilates Locale, its employees and contractors from any liability for injury, loss or damage arising from your participation in our sessions
  • You acknowledge that instructors may use tactile cues or physical adjustments to guide alignment or posture during sessions. If you are uncomfortable with this, you must inform your instructor before the session begins.
  • Pilates Locale excludes all liability for death or personal injury relating to your participation in Pilates sessions, except where caused by our reckless conduct.
  • This includes injuries resulting from negligence, equipment use, or pre-existing conditions, except where caused by our gross negligence or a breach of a consumer guarantee under the ACL.

8.4. Australian Consumer Law Notice

  • Nothing in these Terms excludes or modifies any guarantees, warranties, or rights you may have under the ACL.
  • Where permitted, our liability for breach of any such right is limited to resupply of the services or payment of the cost of resupply.

9. Privacy & personal information

We handle your personal information in accordance with our Privacy Policy (also available at www.pilateslocale.com). This includes how we collect, use, store, and disclose your information via the Momence platform. By booking a class or purchasing a membership, you consent to this use.

10. General provisions

10.1. Amendments

  • Pilates Locale may vary or amend these Terms and Conditions at any time by updating them on its website, through the Momence platform, or by providing written notice. You will be deemed to have accepted any such amendments by continuing to access or use our services after the date of the update or notice.

10.2. Entire Agreement

  • These Terms, together with our Privacy Policy and any additional waivers, policies or documents referred to herein, constitute the entire agreement between you and Pilates Locale in relation to the subject matter and supersede any prior agreements or understandings.

10.3. Waiver

  • Any failure or delay by Pilates Locale to exercise a right or remedy under these Terms does not constitute a waiver of that right or remedy. Any waiver must be in writing and signed by an authorised representative.

10.4. Assignment

  • You must not assign, transfer or otherwise deal with any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without restriction.

10.5. Force Majeure

  • Pilates Locale is not liable for any delay or failure to perform its obligations under these Terms if such delay or failure is due to a cause beyond its reasonable control, including but not limited to natural disasters, acts of war or terrorism, epidemics, pandemics, government restrictions, or failures of suppliers, contractors, or service providers (including software providers such as Momence).

10.6. Severability

  • If any provision of these Terms is held to be void, invalid, illegal or unenforceable by a court of competent jurisdiction, that provision will be severed from the Terms and the remaining provisions will remain in full force and effect.

10.7. Governing Law and Jurisdiction

  • These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland and any courts which may hear appeals from those courts in respect of any proceedings in connection with these Terms.

10.8. Public Health and COVID-19 Policy

  • You must comply with any applicable health directions, vaccination requirements or hygiene protocols in effect at the studio. We may modify access to services, class sizes or schedules to comply with government health orders. Refunds are not issued for cancellations due to public health restrictions unless required by law, but we may offer account credit or extensions at our discretion.

10.9. Intellectual Property

  • All materials, content, videos, guides, and branding provided by Pilates Locale remain our intellectual property and must not be copied, distributed, or used for commercial purposes without our written consent.
